Of the 36 articles of the law, 11 require implementing decrees to be operational, particularly those concerning the operating regimes of self-production sites and the necessary authorizations. The provisions related to the price of surplus self-production to be injected into the national transport network are also affected. In February 2024, the Regulatory Authority set the access prices for the electricity transport network for the period from March 2024 to February 2027. However, a decree is required to install smart meters connected to the transport network at self-production sites.

This delay in adopting the decrees risks hindering the acceleration of the self-production system in the short term. Previous cases show that implementing decrees can take several years to be published. For example, one of the decrees of the renewable energy law was published only five years after the law was adopted, and its entry into force was conditioned by an order published six years after the law.

Currently, the total self-production capacity is 55 megawatts, with several projects underway for the period 2023-2025. These projects include 25 small-capacity installations (0.5 to 1 megawatt) set up by small and medium industrial units, totaling 20 megawatts. In addition, two large projects are underway: a 301-megawatt solar farm by the OCP group and a 100-megawatt wind farm by AM Wind.
